臺北市政府今（27）日表示，Google今日上午表明拒絕依照臺灣消費者保護法的規定
，給予手機應用軟體（APP）消費者七日的鑑賞期，並且揚言暫時停止對臺灣消費者銷售
付費APP。葉主委指出，Google停售付費APP的舉措，顯然是意圖綁架全臺灣的消費者，來
換取拒絕遵循臺灣法律的特權，臺北市政府決定依法裁處一百萬的罰鍰，並再度限令
Google在7月1日之前提出改善計畫。
臺北市政府主任消保官陳碧珠指出，Google Android Market的服務條款中載明，消
費者只能在下載手機應用軟體的十五分鐘內退費，明確違反消保法「郵購買賣」必須准許
消費者在七日內退費的規定，並經市政府限期於上週四（23日）前改善在案，Google上週
五上午要求市府暫不開罰，今日再做最後決定。但Google今日上午由律師代表到市府，並
由美方人員致電市府，明確表示拒絕遵循臺灣消保法的強制規定，並且表示停止付費應用
軟體的銷售，臺北市政府對此表示遺憾，並決定依據消費者保護法重罰Google新台幣一百
萬元，並再度限令Google在7月1日之前提出改善計畫。
臺北市政府法規委員會主任委員葉慶元表示，我國法院以及中央政府已經多次解釋，
網路購物必須適用消保法郵購買賣的規定，手機使用者透過網路購買手機應用軟體，自然
也受到消費者保護法的保障。葉主委指出，雖然部分消費者在網路上指出先前也有成功退
費的經驗，但是目前退費使用介面複雜，而且在業者透過定型化契約明文排除退費責任的
現況下，退費與否變成業者的「恩給」，而不是消費者的權利，此一不合理的契約條款規
定必須修正。
葉主委進而解釋，從去年開始，臺北市政府就開始對網路銷售平台業者宣導必須保障
網路消費者七日猶豫期的規定，從PCHOME等本土ISP業者到Yahoo等國際ISP業者都已經遵
循臺灣的法令辦理，此次向蘋果以及Google兩家手機應用軟體業者宣導，蘋果也接受市府
的規範，只有Google無視法律的規定，要求不被規範的特權，市府無法接受。
葉慶元主委指出，手機銷售平台業者如Google及蘋果在軟體出售後，可透過手機的連
線更新功能，查知軟體是否持續存在於使用者的手機上，所以不至於發生消費者退費後持
續使用相關手機應用軟體的問題。葉主委強調，相關的技術問題對於蘋果的APP Store既
然不造成困擾，Google拒絕配合顯然非常惡意。
陳碧珠主任消保官指出，Google將於本週四派人直接來台溝通，市府將視Google屆時
的立場，決定是否二度開罰。
