請問退貨問題 - MAC

前幾天去晶X買了一隻mac原廠的滑鼠想拿回家給爸爸當禮物(因為之前的壞了)
回到家把滑鼠盒子外膜拆掉之後 發現桌上躺了一模一樣的新滑鼠
原來是老弟已經先買了(大冏)
當天晚上就把滑鼠拿去晶x想退貨
他們一開始說可以換不能退
那我就說可是我都沒用過 裡面也沒打開
後來講一講我就說好吧 那換貨好了(想說換iphone的外殼)
結果工讀生拿去了一下 又跑回來說不能換 因為我已經把包裝的外膜撕掉了
還跟我說這是apple原廠的規定
請問真的有這件事嗎
如果真的是這樣 那我只好摸摸鼻子 因為自己沒跟老弟講好就買@@
如果沒有這種規定
請問我應該如何拿出證據呢?
